Terms of Service
Terms for the XAME website, library and learning app: use, AI, subscriptions and your rights.
Version:
1. Who we are and scope
XAME is provided by Mountain Inc CommV, Anjerstraat 9, 2340 Beerse, Belgium. Enterprise number: BE 0793.753.572. Contact: xame @ xame .ai.
These terms cover xame.ai, the public library and the learning app at app.xame.ai, including the installed progressive web app (PWA). Our Privacy Policy separately explains how we process personal data.
2. Learning with XAME
XAME supports understanding, practice and planning through short learning moments, explanations, visuals, video, practice questions, progress and an AI Coach. The relevant offer describes the available features and subjects. A website demonstration does not automatically mean a feature or course is available in your account.
The public library collects sources, including third-party documents and websites. A listing does not mean a complete XAME course is available. Check the country, level, subject, edition and exam year. Historical practice material does not automatically define current examination requirements.
XAME is an independent learning service, not a school or official examination authority. We do not claim official endorsement or partnership unless expressly stated. Official examination programmes and your school's requirements remain authoritative. Practice results are not official grades or admission decisions. We do not guarantee examination results or admission.
3. Age and parent involvement
XAME accounts are intended for users aged 13 and over. If you are a minor, a parent or legal guardian may need to authorise a contract or a particular processing activity, depending on your country, age and the action. Only use a feature requiring that authorisation after the required authorisation has been obtained.
Inviting a parent is not the same as obtaining valid parental consent and does not automatically give access to conversations, answers or progress. A parent dashboard or parent payment feature is not part of the offer unless actually made available.
4. Your account and safe use
Provide accurate information where needed for your account. Keep login credentials confidential and report suspected misuse using our contact address. A personal account is for its designated user; multi-learner offers have the account limits stated in the offer.
Do not seek access to other people's data, bypass security or subscription limits, distribute malicious software, deliberately overload the service or use XAME unlawfully. You are not automatically liable for every unauthorised use of your account: we consider the circumstances and what could reasonably be expected of you and us.
5. AI, explanations and feedback
AI answers may be inaccurate, incomplete or unsuitable for your situation. Check important information against official sources, teaching material or a teacher. XAME does not replace professional advice or official educational decisions.
We do not currently store personal Coach conversation histories. Questions, answers and feedback are retained for improving XAME learning content only as genuinely anonymous material. This also requires removing identifiable personal information from the text; omitting an account link alone is not sufficient.
Our current AI provider is OpenAI. Necessary questions and learning context are processed to produce an answer as explained in our Privacy Policy. Do not share passwords, payment details or unnecessary sensitive information. Using XAME does not grant general permission to train external AI models with your personal data.
6. Content rights
Rights in XAME software, design and original learning content belong to Mountain Inc CommV or our licensors. You may use available content for your own learning within your account and subscription.
Official sources and third-party materials remain subject to their owners' rights. A link or download does not automatically permit public distribution, sale or republication. Do not copy protected material at scale or commercially exploit it without permission.
You retain your rights in your own original contributions. We use questions and feedback for the service and content improvement described here, not through an unrestricted transfer of your rights. The current service does not offer student uploads of photos or documents or public publication of personal learning results.
7. Free and paid subscriptions
XAME may offer Free and paid subscriptions such as Plus, Max and Family. The offer describes available features, usage limits, currency and prices. Creating a free account alone does not create a payment obligation.
The payment provisions below apply only when you can actually purchase a paid subscription. A planned website price does not mean online payments are available. Before ordering, you will see the total price including applicable taxes, billing period, automatic renewal and cancellation method.
Monthly subscriptions renew automatically each month until cancelled. Payments may be processed through Mollie or Stripe; checkout identifies the method and provider. If payment fails, we inform you and, where appropriate, allow you to resolve it before restricting paid features.
8. Cancellation and price changes
You can cancel a monthly subscription before its next renewal using the method disclosed when subscribing. Paid features remain available until the end of the paid period. Your account then moves to Free with learning history and progress retained, unless you also delete your account.
Cancellation does not automatically entitle you to a partial refund for the current period. Statutory withdrawal rights and remedies for a defective service remain unaffected. We notify you in advance of material changes or price increases; where required, you can end the agreement before the change takes effect.
9. Withdrawal and statutory remedies
EU consumers generally have a 14-day right to withdraw from an online contract unless a legal exception applies. Depending on the legal conditions, this may also apply to digital services supplied in exchange for personal data rather than money.
If you request the service to start within that period, a proportionate charge for services already supplied may apply on withdrawal only where the legal conditions have been met. Separate digital content has different conditions for any loss of withdrawal rights. Logging in or opening the app alone does not automatically waive your rights.
When a contract is concluded, we explain the applicable procedure, model withdrawal form and legally required online withdrawal facility. You can also communicate an unambiguous withdrawal decision using our contact address or by post. We make legally required refunds on time. Your statutory rights to remedies, price reduction or termination for a non-conforming service remain intact.
10. Notifications
XAME may provide learning and service notifications. Optional notifications can be switched off. Where necessary, push notifications require permission through your device or browser. This permission does not automatically cover newsletters; we do not currently send marketing newsletters.
11. Account deletion and retention
You can exercise privacy rights through the contact address in our Privacy Policy. A standard account deletion feature in Profile is planned; we do not describe it as a working button until it is available.
On account deletion, personal data in active systems is deleted within 30 days unless a valid legal exception applies. Genuinely anonymous material for content improvement may remain. Necessary financial records and information for a specific dispute may be kept longer, but are not reused for ordinary learning activities. Our Privacy Policy describes the separate retention rules.
12. Availability and responsibility
We maintain and secure XAME with reasonable care. Maintenance and outages may temporarily affect availability. Changes respect existing contracts and statutory consumer rights.
We may restrict access where necessary because of serious misuse, a security risk or a legal obligation. Where possible, we explain the reason and allow mistakes to be corrected. We do not exclude liability where exclusion is prohibited or restrict mandatory consumer rights.
13. Complaints, governing law and changes
For questions or complaints, contact xame @ xame .ai. We will try to find a solution together. Belgian law applies without depriving you of mandatory protections applicable in your habitual country of residence. You retain access to legally competent courts and complaint bodies.
These terms do not impose mandatory arbitration or waive statutory consumer rights. We appropriately notify existing users of important changes. New terms do not silently change existing contracts retrospectively.
